1 . TRAVELER CAPACITY (all guests included):
Texas Tranquility - 5 people; Lone Star Serenity - 4 people; Combo of both - 9 people
2. BOOKING: You certify that you agree to and understand the limitations placed on the number of persons permitted to occupy the Rental, and unless prior written approval has been granted by Lane Family Enterprises, LLC, you agree to abide by such limitations. Above Renter is at least 25 years of age and will be an occupant of the unit during the entire reserved period. Third party bookings are not permitted. Therefore, the person making the reservation must be staying on the property as they are taking responsibility for the stay. Photo ID may be required at check-in or during the stay. If your booking was made under false pretense, including, but not limited to, a falsified name, age or size of party, you will be subject to immediate cancellation of your reservation, removal from the property, and forfeiture of all amounts paid.
3. CHECK-IN/CHECK-OUT: Check-in is at 3pm. Door code will not be activated until the agreed check-in time. Check-out is at Noon. Early/Late check-in/check-out options may be available but cannot be guaranteed. Early options will fully depend on others that check-in/check-out on the same day.
4. CANCELLATION POLICY: Full refundable for cancellations up to 30 days before check-in. After that, reservation would be non-refundable.
5. COURTYARD: The shared courtyard area is outdoors that is fenced in. Our property is across the street from over 1000 acres. This allows our area to enjoy some much appreciated quiet and wildlife. We ask that if you eat or grill outside, when you discard your food and items in the garbage, you close the garbage lid down tight. Wildlife gets hungry too!! We also ask that doors not be kept open for critters. Reminder: If you are reserving one unit and not the combo unit, the courtyard would be shared with the other unit. Please be courteous.
6. REQUIRED DAMAGE PROTECTION AND CREDIT CARD CHARGES POLICY: In lieu of collecting a large security deposit as most hosts do, Lane Family Enterprises, LLC will collect, for each reservation, a one-time non-refundable $49.00 damage waiver fee. The damage waiver is provided by Waivo, a third-party vendor who is not affiliated with Lane Family Enterprises, LLC. Generally, the damage waiver provides up to $5,000 of coverage towards unintentional property damage.
The coverage is subject to all applicable terms and conditions imposed by Waivo (https://waivo.io/), including, without limitation, those terms and conditions described on their site. Waivo’s terms and conditions are subject to change at any time without notice. Lane Family Enterprises, LLC is not responsible for any changes to or variance in Waivo’s terms and conditions. Renter is responsible for obtaining accurate and up-to-date terms and conditions directly from Waivo at the time of purchase. If for any reason whatsoever, Waivo fails or refuses to cover any costs or expenses incurred due to damages resulting from your stay, Lane Family Enterprises, LLC shall be entitled to charge the credit card on file or otherwise collect such additional amounts as may be incurred for damages or theft, including, without limitation, the market rate for replacement of costs or repairs plus time and materials, in addition to seeking any relief provided by law. https://waivo.io/client/southern-country-hospitality/
7. ADDITIONAL POLICIES: The easiest way to disrupt an enjoyable stay is a plumbing problem. To prevent this, we kindly ask you to please place things like sanitary napkins, paper towels, and baby wipes in trash containers provided. Our sensitive pipes are on a strict diet of septic toilet paper and will throw up any other items. Outdoor Video/Audio monitoring system installed in courtyard area. Owners live onsite. WEATHER / ACTS OF GOD: Host is not responsible for any weather conditions or acts of god or nature that happen during the travelers stay.
8. NO PETS OR SMOKING ARE ALLOWED: Since many travelers have allergies and it is difficult to remove the odors and allergens associated with both pets and smoke, we must STRICTLY ENFORCE this policy. If evidence of pets on site or evidence of smoking inside the Rental is found, Lane Family Enterprises, LLC reserves the right to assume a damage/deep cleaning fee of $500 to treat the property for allergens or odors. In addition, any damage caused by pets or smoking materials will be charged to Renter damage deposit or credit card on file.
9. PARKING: Room for ONLY TWO vehicles at the uncovered Guest Parking marked spots PER UNIT. (So, four vehicle parking spots for the combo unit reservation).
10. NOISE: Due to being courteous to our neighbors, we do ask that loud music to be turned down after 10pm. Parties and events are not permitted.
11. LIMITED SHORT-TERM RENTAL: It is expressly understood and agreed that this is a short-term vacation rental and is not a lease or other long-term residential tenancy agreement. This Agreement is only for the licensed use of the Vacation Rental for the stated reservation dates. It creates no property rights for you and no rights to renewal or for recurring usage. You shall not sublet the Vacation Rental or any part of it and shall not assign any interest (in whole or in part) to this Agreement or any rights hereunder.
12. ADDITIONS TERMS AND CONDITIONS: Due to circumstances that may be out of the travelers' control, we highly suggest purchasing travel insurance prior to your stay. Traveler acknowledges and agrees that they are responsible for the safety of themselves, their guests, and their children with respect to the premises.
By requesting a booking at our location, you have accepted responsibility and acknowledgement to abide by the property policies. Violation of any portion of this agreement may result in immediate removal without any reservation reimbursement.
HOLD HARMLESS: Lane Family Enterprises, LLC does not assume any liability for loss, damage, or injury to persons and/or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity, or plumbing. Nor will Lane Family Enterprises, LLC accept liability for any loss or damage caused by weather conditions, natural disasters, or other reasons beyond our/its control.
Renter agrees to accept liability for any damages caused to the property by renter and their guests including, but not limited to, damage to the Rental in any way or damage to any appliances and/or equipment furnished. Renter agrees to reimburse Lane Family Enterprises, LLC for costs incurred to repair/replace damaged items. Host is not responsible for any weather conditions or acts of God or nature that happen during the travelers stay.
The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Lane Family Enterprises, LLC, from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Lane Family Enterprises, LLC free and harmless of any claim or suit arising therein. In any action concerning the rights, duties, or liabilities of the parties to this agreement, their principals, agents, successors, or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs. If Renter or Renters guest violates any conditions of this agreement, Lane Family Enterprises, LLC may terminate this agreement and enter premises. Upon notice of termination of this agreement, Renter and guests shall vacate the premises immediately. In the event Lane Family Enterprises, LLC must resort to legal process to enforce rights under this Agreement, Renter shall be responsible for reasonable Attorney fees and costs. Renter agrees this contract is entered into in Hays County, Texas, and consents to the personal jurisdiction of any proper court located therein.
